These terms apply when you order from bedifferentpackaging.com. Placing an order means you accept them.

Who you are contracting with

Be Different Packaging is a trading name of Victor The Label (Pty) Ltd, a company registered in South Africa.

When an order becomes a contract

Adding items to a basket or reaching checkout does not create a contract. A contract forms when we confirm your paid order by email. Until then we may decline an order, for example if stock has run out or a price was published in error.

If we decline after you have paid, we refund you in full. We do not hold your money against a future order unless you ask us to.

Prices, currency and what your card is charged

Prices are in South African rand and exclude delivery, which is quoted at checkout. Your card is charged in rand. If your card is denominated in another currency, your bank converts at their own rate on the day, so the amount on your statement can differ from any converted figure shown on the site.

Figures shown in another currency are approximate and for guidance. The rand price is the price.

Prices can change without notice, but never for an order we have already confirmed. Where a large branded order has its exchange rate held for a stated period, we honour that quote for that period.

Customisation

Printed and colour-changed work is made to your order. You approve the artwork before production starts, and what you approve is what is produced. We cannot accept a change of mind on printed stock once production has begun, which is why the minimum for printed work is 2,500 units.

You confirm that you own or are licensed to use any logo or artwork you send us, and that it does not infringe anyone else’s rights.

Delivery and lead times

We ship worldwide. Stated lead times are estimates rather than guarantees, because they depend on production and on freight and customs clearance.

Risk passes to you on delivery. If an import duty or local tax applies in your country it is payable by you, and it is separate from what you pay us. See Shipping for current timelines.

Returns, damage and faults

You have 14 days from delivery to change your mind on plain, unused stock. Report damage, a shortage or the wrong item within 7 days of delivery and send a photo. Nothing has to be sent back for a damage claim.

Faulty goods carry the 6-month implied warranty under the Consumer Protection Act. Nothing in these terms limits your rights under that Act or under the Electronic Communications and Transactions Act. Full detail is on the Returns page.

Cancelling an order

You can cancel a plain-stock order for a full refund at any point before it ships. Once a customised order has entered production it cannot be cancelled, because the goods are made for you and cannot be sold to anyone else.

What we are responsible for

We are responsible for supplying goods that match their description and are of reasonable quality. Where something goes wrong with an order, our liability is limited to the value of that order.

We are not liable for losses that follow on from a late or faulty delivery, such as lost sales or a missed launch date. Packaging is one input into your product and we cannot carry the risk of the whole product. Nothing here limits liability for death, personal injury or fraud, which cannot be excluded by law.

Your account

Keep your password to yourself, and tell us if you think somebody else has used your account. We can suspend an account being used fraudulently or to abuse trade pricing.

Changes, and the law that applies

We may update these terms. The version published when you place an order is the one that applies to it, so a later change does not affect an order already confirmed.

These terms are governed by South African law, and the South African courts have jurisdiction. If part of them is found unenforceable, the rest continues to apply.

Complaints

Email sales@bedifferentpackaging.com with your order number and a person will answer. If we cannot resolve it between us, you can take a complaint to the National Consumer Commission.
